Please read these Terms carefully before using the Lumen Medical website, patient portal, or receiving our healthcare services. By accessing or using our platform, you agree to be bound by this agreement.

Welcome to Lumen Medical (“Company,” “we,” “us,” “our”). These Terms of Service (“Terms”) govern your access to and use of our website (www.lumenmedical.com), patient portal, mobile application, telehealth services, and any related content, features, or services (collectively, the “Services”). These Terms constitute a legally binding agreement between you and Lumen Medical. If you do not agree to these Terms, please do not use our Services.
1. Eligibility & Account Registration
By using our Services, you represent and warrant that:
- You are at least 18 years of age (or the age of majority in your state) OR have obtained verifiable parental/guardian consent if you are a minor receiving care.
- You have the legal capacity to enter into a binding agreement.
- You will provide accurate, current, and complete information during registration and will update it promptly if changes occur.
- You are not located in a country subject to U.S. trade sanctions or prohibited by applicable law from receiving medical services.
When you register for our patient portal, you will create login credentials. You are solely responsible for maintaining the confidentiality of your password and account. Notify us immediately of any unauthorized use. Lumen Medical reserves the right to suspend or terminate accounts that violate these Terms or pose a security risk.
2. Medical Disclaimer & No Emergency Services
While we strive to provide accurate and up-to-date health information, medical knowledge evolves rapidly. We make no warranties regarding the completeness, reliability, or accuracy of any clinical content on our platform. Your reliance on any information provided by Lumen Medical is solely at your own risk. The physician-patient relationship is formed only after you schedule and complete an in-person or telehealth consultation, and appropriate consent forms are signed.
3. Telehealth & Virtual Care Terms
Lumen Medical offers telehealth services as a convenient option for eligible patients. By participating in a telehealth visit, you acknowledge and agree to the following:
- Telehealth involves the use of secure video conferencing to deliver healthcare services remotely.
- While we use industry-standard encryption, no internet transmission is 100% secure, and there are inherent privacy risks.
- Telehealth may not be suitable for all medical conditions (e.g., emergencies, complex physical exams). Our providers reserve the right to transition you to an in-person visit if clinically necessary.
- You are responsible for providing a private, well-lit environment and a stable internet connection.
- Recording of telehealth sessions is strictly prohibited without prior written authorization from Lumen Medical.
- Telehealth services are billed similarly to in-person visits, and copays or deductibles apply as per your insurance plan.
We will obtain your informed consent for telehealth before each virtual consultation. You may withdraw consent at any time, but that may require rescheduling as an in-person appointment.
4. Appointments, Cancellations & No-Show Policy
To provide quality care to all patients, Lumen Medical enforces a cancellation and no-show policy:
- Cancellations: You may cancel or reschedule an appointment online via the patient portal or by phone at least 24 hours before your scheduled time without penalty.
- Late Cancellations (less than 24 hours): A $50 fee may be applied.
- No-Show: Failure to arrive for a scheduled appointment without prior cancellation will result in a $75 no-show fee. Repeated no-shows (3 or more within 12 months) may result in discharge from the practice.
- Late Arrival: If you arrive more than 15 minutes late, we may need to reschedule your appointment to avoid disrupting other patients. Late arrival fees may apply at the provider’s discretion.
We understand emergencies happen. If you experience an unforeseen emergency, please contact us as soon as possible, and we will waive fees on a case-by-case basis.
5. Billing, Payments & Insurance
You agree to pay all fees associated with services rendered by Lumen Medical. Payment is due at the time of service unless other arrangements have been made in writing. We accept cash, credit/debit cards, HSA/FSA, and most major insurance plans.
- Self-Pay Patients: Prices listed on our website are estimates and subject to change based on complexity of care, supplies used, or additional procedures.
- Insurance: We will submit claims to your insurance provider as a courtesy. However, you are ultimately responsible for any deductibles, copayments, coinsurance, or denied claims. Verify coverage with your insurer before scheduling.
- Collections: Unpaid balances beyond 90 days may be referred to a collections agency. You agree to pay all collection costs, attorney fees, and interest as permitted by law.
- Disputed Charges: If you believe a charge is incorrect, you must notify our billing department within 30 days of the statement date. We will investigate and adjust if necessary.
6. Intellectual Property Rights
All content on the Lumen Medical website, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and documentation, is the property of Lumen Medical or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and view the content for personal, non-commercial use only. You may not:
- Copy, reproduce, distribute, modify, create derivative works of, or publicly display any content without our prior written consent.
- Use any data mining, robots, or similar automated data gathering methods.
- Remove any copyright, trademark, or proprietary notices.
- Use the Lumen Medical name, logo, or trademarks without express permission.
Violation of these intellectual property terms may result in termination of your access and legal action.
7. User Conduct & Prohibited Activities
When using our Services, you agree not to:
- Post, transmit, or share any false, misleading, defamatory, obscene, or unlawful content.
- Impersonate another person or entity, or falsely state your affiliation with any organization.
- Attempt to gain unauthorized access to our systems, patient data, or other users’ accounts.
- Introduce viruses, Trojan horses, worms, or other malicious code.
- Interfere with the operation of our Services, including overloading infrastructure or bypassing security measures.
- Use the Services to send unsolicited commercial messages (spam).
- Harass, threaten, or abuse any staff member, provider, or other patient.
We reserve the right to monitor user activity, terminate access for violations, and cooperate with law enforcement investigations.
8. Third-Party Links & Integrations
Our Services may contain links to third-party websites, such as laboratory portals, pharmacy services, or insurance verification tools. These links are provided for your convenience only. Lumen Medical does not control, endorse, or assume responsibility for the content, privacy practices, or terms of any third-party site. Your interactions with third parties are solely between you and them. We encourage you to read the terms and privacy policies of any external sites you visit.
9. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, LUMEN MEDICAL PROVIDES ITS SERVICES ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE OPERATION OR AVAILABILITY OF OUR SERVICES, OR THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT. THIS INCLUDES IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LUMEN MEDICAL, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR SERVICES DURING THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.
This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability). Some states do not allow the exclusion of incidental or consequential damages, so the above exclusion may not apply to you.
11. Indemnification
You agree to defend, indemnify, and hold harmless Lumen Medical, its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the Services; (c) any content you submit or transmit; or (d) your violation of any third-party rights or applicable laws.
12. Termination
Lumen Medical may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will cease immediately. Provisions that by their nature should survive termination (e.g., intellectual property, disclaimer of warranties, limitation of liability, indemnification) shall survive.
13. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) in Travis County, Texas, in accordance with its Consumer Arbitration Rules. Judgment on the award may be entered in any court having jurisdiction. You agree to waive any right to a jury trial or to participate in a class action lawsuit.
Exceptions: Either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property rights or prevent unauthorized disclosure of confidential information.
14. Modifications to Terms
We reserve the right to update or modify these Terms at any time without prior notice. The latest version will be posted on this page with the “Last Modified” date. Changes become effective immediately upon posting. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms. Material changes will be communicated via email or website banner.
15. Entire Agreement & Severability
These Terms, together with our Privacy Policy and any other legal notices or consent forms you sign, constitute the entire agreement between you and Lumen Medical regarding the Services. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
